How it works
Tax residency is not citizenship and not your visa — it is a day-count test. Spend 182+ days in India in a financial year and you are resident. Otherwise, 60 days this year plus 365 days in the previous four also makes you resident (relaxed to 182 days for Indians leaving for employment).
Why it matters: residents pay tax on global income; NRIs pay only on India-source income. And NRE account interest — completely tax-free for NRIs — becomes taxable the day you turn resident again, so returning Indians should rejig deposits promptly.
The expensive mistake is assuming NRI status without counting: short trips home add up, and the 60+365 test catches many "I live abroad" taxpayers who visit family for two months a year.
Frequently asked questions
How many days make me an NRI?
Fewer than 182 days in the FY, AND failing the 60-days-this-year + 365-days-in-4-years test. Both conditions use physical presence — a day counts if you are in India any part of it.
I left India for a job. Which rule applies?
The relaxed one: for Indian citizens leaving for employment (or crew members), only the 182-day test applies — the 60+365 test is waived for the year of departure.
Is NRE interest really tax-free?
Yes, under 10(4)(ii) — while you are NRI. The exemption vanishes when you become resident again; many returnees forget and keep earning "tax-free" interest that is now taxable.
What about NRO account interest?
Fully taxable at slab rates, with 30%+ TDS deducted at source. Claim credit/refund when filing — TDS is not the final tax.
Does India tax my foreign salary as NRI?
No — foreign-source income is outside Indian tax for NRIs. But if you are resident, it is taxable in India with DTAA credit for tax paid abroad.
What is RNOR status?
Resident but Not Ordinarily Resident — a transitional 2–3 year status for returning NRIs. RNORs are taxed like NRIs on foreign income. This calculator simplifies it away; a CA should confirm.
Do NRIs get the ₹12L new-regime rebate?
Yes — the 87A rebate applies to NRIs too on eligible income. But NRIs cannot use ITR-1 for capital gains or foreign assets; ITR-2/3 applies.
Is rental income from Indian property taxable for NRIs?
Yes — India-source, fully taxable, with 30%+ TDS by the tenant. The 30% standard deduction under 24(a) still applies.
What is the ₹15 lakh deemed residency rule?
Indian citizens with India income above ₹15L who are not liable to tax anywhere else can be deemed resident. It targets stateless high earners — an edge case, but real.
Which documents prove foreign tax credit?
Form 10F, a Tax Residency Certificate from the other country, and proof of tax paid. File these to claim DTAA relief under Section 90/91.
